Welcome to SmartBird (smrtbird.com), which provides global network acceleration. Please read these terms in full before you download, install, or use our client or related services. By using the service, you agree to be bound by these terms. We may revise the terms from time to time; please review this page regularly. Continued use after updates constitutes acceptance of the revised terms.

1. The service

SmartBird provides global network acceleration that aims to be secure, stable, and low-latency, including accelerated connectivity, multi-region routing, and multi-device support. Due to network conditions and applicable rules, we do not guarantee identical performance in every region or for every website or application. You bear the risks arising from content or services you access through third parties while using our acceleration service.

2. Acceptable use

You must not use the service for any illegal activity. The product is provided solely for compliant network path optimisation and lawful access to Internet resources under applicable law.

You must comply with applicable laws and must not misuse the service for unlawful purposes. If you violate the law or these terms, we may suspend or terminate service and pursue remedies available to us. Without limitation, you must not:

a. Engage in illegal, threatening, violent, inciting, defamatory, obscene, fraudulent, or other unlawful conduct;

b. Transmit or distribute unlawful, obscene, threatening, harassing, defamatory, privacy-invading, or IP-infringing material;

c. Distribute content harmful to minors;

d. Collect others’ personal information without legal basis or consent, or process personal data in violation of applicable law;

e. Access others’ computers or networks without authorisation, or disrupt other users’ connections;

f. Modify, translate, reverse engineer, decompile, or disassemble our client, website, or documentation, or attempt to obtain source code, algorithms, or implementation details;

g. Scrape, copy, or harvest the service or related data by automated or improper means without our written permission;

h. Engage in other conduct that violates public order, good faith, or these terms.

For account security, do not lend or share your account. If you share your account, you assume all resulting risks and consequences.

3. Privacy

We treat privacy seriously and process personal information as described in our Privacy Policy. Please read that policy before using the service.

4. Availability

We use reasonable efforts to keep the service stable and available. However, due to maintenance, upgrades, network issues, force majeure, and other factors, we cannot guarantee uninterrupted or error-free service. The service provides network acceleration only; we do not review or endorse third-party sites, applications, or content you reach while using it, and you assess and bear related risks yourself.

5. Account security

You are responsible for safeguarding your credentials and for all activity under your account. If you suspect unauthorised use, notify us immediately through official channels.

6. Refunds

You may request a refund when the following conditions are met (subject to rules we publish from time to time):

Purchase channel: Subscriptions must be purchased through our official website, official client, or other channels we authorise.

Eligible cases: After purchase, if support confirms that the acceleration service cannot be provided normally due to our fault.

Refund amount: Calculated according to remaining subscription period or applicable rules, as confirmed by support.

Non-refundable cases include, without limitation: violations of local law; unauthorised commercial use (resale, subletting, using the channel for crawling, etc.); account sharing, abuse, or sustained abnormal high-volume use.

Process: Contact support with details; after verification, refunds are generally returned to the original payment method within a reasonable time; payment-channel fees may be deducted where applicable.

7. Disclaimer

The service depends on the Internet and third-party infrastructure and may be affected by malware, attacks, instability, link failures, and other factors. We do not guarantee absolutely continuous, uninterrupted, or error-free service. To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for losses beyond the fees you paid for the service, arising from use or inability to use the service (except where mandatory law provides otherwise).

8. Changes and termination

We may modify the service or these terms, or suspend or terminate part or all of the service, in accordance with applicable law. Maintenance and upgrades may cause brief unavailability. If you materially breach these terms, we may suspend or terminate your account. Interpretation of these terms and matters relating to use of the service shall, to the extent permitted by law, belong to the SmartBird operator.
